Swedish Regulator Hands Out Fine and Warning to Kanon Gaming

Spelinspektionen, the Swedish Gaming Authority (SGA), has announced it has issued a penalty fine of SEK 7 million and a warning to Kanon Gaming, the gaming company, for serious violations of gambling legislation in the country.

The breaches of the Gambling Act in the Swedish jurisdiction were found during an audit of the gaming operations at Kanon Gaming. The regulator highlighted several areas of concern where Kanon Gaming did not follow the guidelines set out in the gambling legislation in Sweden. These failures related to customers who had been flagged as being at risk from gambling-related harm.

The Swedish Gaming Authority notes that all audited customers have shown signs of excessive gambling. Despite numerous signs of excessive gaming, Kanon has Gaming Limited (KanonGaming) did not take adequate steps to help customers to reduce their gambling.

Kanon Breached Duty of Care Rules in the Gambling Act

Among the Kanon Gaming failures outlined by the Spelinspektionen were the poor contact with customers who were marked as at risk. Many customers were not contacted even though they were flagged due to their gambling activities. This included follow-up calls which were often not undertaken, and in essence, customers had to manage their own responsible gambling actions.

The audit found Kanon Gaming had not kept records and the documentation on customer care was poor. This lack of documentation and adequate procedures in place to offer customers flagged at risk, help and support is another breach of the Gambling Act in Sweden.

In the statement, the SGA said it had placed Kanon Gaming under supervision for six months and instructed the company to instigate appropriate procedures during its gaming operations that provide its customers with an adequate duty of care.

The two action plans that the company has presented to the Gaming Authority, dated January 2023 and June 2023, have not concretely described how the company must fulfill the duty of care.
