The operator was fined AU$60,000 for posting illegal gambling ads on Facebook and Instagram. The ads were ruled to have contravened the NSW wagering advertising regulations, which were put in place to protect people from misleading gambling promotions.

The ads in question were five in number and posted by Colossalbet’s PuntHub brand in October 2023. They violated the Betting and Racing Act 1998, which mandates that all gambling ads targeting NSW residents comply with strict standards.

This is the first time a wagering operator in NSW has been prosecuted and convicted for publishing ads which offend standards of decency, dignity and good taste. L&GNSW actively monitors gambling advertising across all platforms and will not hesitate to take enforcement action where necessary. This is a serious penalty. I would urge betting providers take note and ensure the standards in the Act are being met in their advertising.

NSW Takes Stand Against Inappropriate Gaming Ads

The ruling, delivered by a Magistrate at Downing Centre Local Court, has set a precedent for the enforcement of responsible gaming advertising standards in NSW.

While the regulator had never convicted an operator regarding advertising before this case, it sends a message to the industry that it will not tolerate irresponsible advertising practices.

Earlier this year, the NSW labor government announced a blanket ban on gambling ads across the state’s public transport system.

With the ban, the government aims to reduce the influence of gambling promotions on vulnerable groups, including children.
