NorthStar Gaming Hit with $30K AGCO Fine

The Alcohol Gaming Commission Ontario (AGCO) has imposed a $30,000 fine on NorthStar Gaming (Ontario) for regulatory breaches, including failing to restrict access to its site NorthStarBets.ca to Ontario residents.

According to the AGCO, gaming sites registered in the province can only offer games to players within Ontario unless they are approved by another provincial government. This mandates that online gaming operators geographically restrict their services to Ontario residents.

As part of its ongoing compliance efforts, the AGCO initiates regular third-party assessments of the gaming sector. It conducted accessibility tests on Ontario gaming sites from locations in Quebec and New York to check whether individuals outside of Ontario could access them.

However, the AGCO stated that NorthStarBets.ca was unable to precisely detect the location of a device during testing.

The crown agency is also taking action against the operator for repeatedly failing to provide the requested data, information, and documents to the registrar within the required timeframe.

Operators issued an Order of Monetary Penalty can appeal to the License Appeal Tribunal, a neutral adjudicative tribunal.

The AGCO is responsible for regulating and overseeing the alcohol, gaming, horse racing, and cannabis retail sectors in Ontario, Canada. It was established in 1998 from a merger of the Liquor Control Board of Ontario (LCBO) and the Ontario Casino Corporation. It became the regulator of Ontario's online iGaming and sports betting sector when the market went live in April 2022.
