KSA Removes Illegal YouTube Gambling Promotions in the Netherlands

Kansspelautoriteit (KSA), the Dutch gambling regulator has announced it successfully shut down a video promoting an unlicensed gambling operator on a YouTube channel.

KSA says the content relates to two YouTube influencers who have been promoting gambling websites on the platform in the Dutch jurisdiction, and the regulator has highlighted that the gaming operators in the promotion are unlicensed in the region and it is therefore an illegal gambling operation.

The individuals behind the YouTube videos mounted a defence saying that they had blurred out pictures of the names of the gambling websites. However, the KSA said audio on the video was still clearly audible and the influencers were recommending to their subscribers to visit the gaming websites.

Following this exchange the Kansspelautoriteit issued a second and final warning to the YouTube influencers, which resulted in the successful removal of the promotional video. The Dutch regulator expressed it was taking a zero tolerance to these types of breaches of gambling legislation and is prepared to issue penalty fines once it has exhausted its warnings procedure.

The KSA has been sending warning letters for some time to websites of regional media, among others, that advertise illegal offers, This type of advertising is often also aimed at vulnerable target groups, for example players who are in the Cruks deregistration register.

KSA Reminds Media Platforms of Their Responsibilities

The Dutch regulator stated it had sent out letters to all the media platforms in the country and reminded them of the guidelines relating to gambling legislation that they are expected to comply with. Media platforms can be held responsible for gambling advertisement content on their media platform and following a warning the regulator can start to instigate the financial penalty process.

The KSA also outlined that if individuals on their platforms breach rules set out in the Gambling Act, then the media organizations are also found to be in breach of the legislation. Additionally, KSA warned the media entities that failure to comply with gambling legislation could lead to further action, including the option of a hefty financial penalty.

The Dutch gambling authority has shown its recent commitment to enforcement of the country’s gambling legislation and the regulator takes swift action on enforcement issues. The gambling regulator closely monitors the promotion of gaming industry activities and this follows a crackdown on untargeted gambling ads.

The KSA often receives feedback that the media were not aware of the fact that the advertised website does not have a license for the Dutch market. The supervisory authority would like to point out once again that an advertiser is responsible for checking whether a gambling company that wants to advertise with them has a license. If an advertiser advertises illegal offers, they themselves run the risk of a sanction.
