KSA Hands Out a Hefty Fine to MKC for Breaching the Gambling Act
LISTEN TO THIS ARTICLE:Kansspelautoriteit (KSA), the Dutch Gambling Authority, has announced it has handed out a €900,000 fine to MKC for breaches of the Dutch Betting and Gaming Act.
MKC operates the Betworld247 brand, which lost its gaming license to operate in Malta earlier this year. In effect, this made Betworld247 unlicensed in the Netherlands, but the operator continued to offer customers in the jurisdiction the chance to wager at its gambling site.
The KSA said that MKC had made no attempt to block users in the Netherlands from accessing the Betworld247 website, and this is a clear breach of the gambling legislation in the country.
MKC's Lack of Age Verification
One of the issues raised by the country's gambling regulation authority was that the Betworld247 brand had no checks to verify the age of potential players on the website.
One of the cornerstones of a responsible gambling policy is the protection of vulnerable people. All under-age players are regarded as vulnerable as they should not be exposed to the potential of gambling. Because there were no checks for age verification on the website, KSA stated it had a dramatic impact on the size of the fine so high.
At MKC Limited, players could enter an age themselves without clear identification. This means that their website is also accessible to very vulnerable underage players. This is a seriously culpable offense, which we have also included as an increasing factor for the fine. It shows once again that in many cases, little attention seems to be paid to the safety of players on the illegal market.
KSA Initiates a Cease and Desist Order
The Dutch regulator has followed a policy of issuing a warning to gambling companies that are in breach of the country's gambling legislation by handing out a Cease and Desist order. The order lays out the violations by the gaming operator and gives the company that continued breaches of the legislation will result in a fine.
MKC was placed under investigation by the KSA in May this year, and following multiple breaches of Dutch gambling legislation, the regulator instructed the Betworld247 site to cease and desist its gambling activities in the Netherlands.
KSA has recently issued a large fine to LCS, totaling €2 Million, following another investigation into breaches of gambling legislation in the region. LCS had also been given an earlier warning with a smaller penalty notice and instructed to cease all breaches of gambling legislation.
