Governor Hochul Approves New Mobile Gaming Ad Rules in NY

Mobile gambling and sports betting ads in New York must now include warnings about the potential harms of gambling.

On October 1, the Governor of New York, Kathy Hochul, signed a landmark legislation that will require all internet sports betting and gambling ads in the state to feature cautionary statements about the risks associated with gambling.

Under existing laws, gambling ads are required to clearly display problem gambling hotline numbers. However, this mandate did not explicitly cover online or mobile sports betting operations despite being subject to the New York State Gaming Commission’s responsible gaming regulations.

The new legislation that was signed into law by the governor, Bill S1550/A1118, subjects mobile sports betting ads to the same rules as other gaming-related promotions. State Sen. Leroy Comrie, with State Sen. Luis R. Sepúlveda as co-sponsor, introduced the Senate version of the bill to the state's Senate Committee for Racing, Gaming, and Wagering on January 6, 2023.

Protecting New Yorkers from the dangerous and addictive effects of problem gambling and sports betting is vitally important for the prosperity of our great state. I want New Yorkers to be able to safely enjoy the activities they love, while proceeding with caution when necessary. I’m confident that with the signing of this new bill, New Yorkers will have easier access to the safety resources they need to better protect themselves from the grips of addiction.

Additionally, Bill S1550/A1118 directs the Gaming Commission to collaborate with the Office of Addiction Services and Supports to ensure that all gaming advertisements display a problem gambling hotline number.

With the signing of this bill, Gov.
