Senator Irajá Abreu (PSD-TO) is set to introduce the Bill, and as its chief sponsor, he will call on Senators to support the attempt to modernize gambling laws governing casinos, bingos, horseracing, and instant win games such as jogo do bicho.

The Senate has awaited this debate for over two years since Abreu inherited the project from former rapporteur Renato Vianna (MDB-SC).

Bill to Overturn 1946 Casino Ban

Key proposals in the Bill include repealing President Gaspar Dutra’s 1946 Decree Law that banned casinos in Brazil. The Bill proposes granting states ‘municipal autonomy’ to operate gambling establishments, provided they meet legal requirements related to population, socio-demographics, and the venue’s size, location, and type.

For casinos, the Bill allows the populous states of Rio de Janeiro, Minas Gerais, Paraná, and Amazonas to each host two casino resorts, while São Paulo would be permitted three within its borders.

The Justice and Citizenship Commission (CCJ) has reviewed a provisional framework imposing a 17% tax on gross income from games and wagers at brick-and-mortar casinos. Additionally, a 20% tax will be levied on all prizes and winnings exceeding R$10,000 (€1,600). The framework permits states to allocate the revenue from gambling taxes to local projects promoting tourism, sports, culture, and various social initiatives.

Finance Minister Fernando Haddad supports the modernization of gambling laws, noting that Brazil should align with other OECD and G20 nations, where 90% have regulated gambling markets.

Nonetheless, a thorough review of Bill 2234/22’s provisions is anticipated, many of which were initially drafted a decade ago by rapporteur Renato Vianna.

The progress of Bill 2,234/2022 will occur separately from the imminent launch of Brazil’s federal sports betting marketplace (Bill No. 3,626/2023), under the Bets framework overseen by the Ministry of Finance and the Secretariat of Betting and Prizes (SPA). This week, the SPA finalized the technical modalities to authorize the licensing process for the Bets market, set to begin on 1 January 2025.
