Brazil Issues Ordinance to Restrict Gambling Ads Targeting Minors

The Brazilian gaming regulator, Secretariat of Prizes and Bets (SPA), has implemented new legislation which places restrictions on the advertising activities of gaming operators to protect minors.

The statement referred to Ordinance No 1,902 and under the terms of the legislation any gambling advertisements that target under eighteens or on channels where the majority of the audience are children are to be banned.

Additionally, all communications from gambling companies must include Mandatory Age Warnings and the related symbol, to remind users that gambling in the country is prohibited for children under eighteen. The statement said these measures are to come into effect immediately.

The authorities in Brazil are concerned that vulnerable individuals including minors are protected in the upcoming new regulated gambling market in the country and are trying to set up a gambling framework before the new regulated market starts next year.

Brazil Sets Guidelines for New Regulatory Gaming Market

As the introduction for the new regulated online gaming framework is close to launching next year, the authorities in the country are trying to introduce legislation that promotes responsible gambling and creates a safe environment for customers in the region.

These changes are part of a suite of amendments being set by the Brazilian regulators and complement another similar Ordinance No. 1,231 issued in July and relating to the regulated gaming market starting on January 1st, 2025.

Last month Brazilian authorities introduced new guidelines that prohibited gambling adverts promoting bonuses.

It establishes rules and guidelines for responsible gaming and for communication, advertising and marketing actions, and regulates the rights and duties of bettors and operating agents, to be observed in the commercial exploitation of the fixed-odds lottery betting modality.
