Aviator LLC has successfully won a $330 million judgment in a trademark and copyright infringement case against Spribe OÜ and Adjarabet, a brand owned by Flutter.

The dispute was regarding the use of the Aviator name and logo in a popular crash game bearing the same title. The Court of First Instance in Georgia ruled that Spribe had violated Aviator’s trademark and copyright protections. As such, it invalidated the trademark registrations that Spribe had filed and awarded Aviator LLC $330 million in damages.

Spribe Registered Aviator Trademark in 2021-22

During the 2021-2022 period, Spribe registered the Aviator trademark, specifically for use in computer games and gambling services. Since then, the Aviator game has risen to prominence as one of the leading crash games available, particularly on Adjarabet, one of the largest online casinos in Georgia.

Aviator LLC initiated legal proceedings against the Flutter-owned Adjarabet on two key grounds. Firstly, they argued that Spribe had acted in bad faith by registering trademarks despite knowing about the pre-existing Aviator brand. Secondly, they claimed these registrations infringed upon Aviator’s copyright. As part of the legal action, Aviator also sought to stop Adjarabet from using its copyrighted material in the crash game named ‘Aviator.’

Court Orders Cancellation of Spribe’s Trademarks

On August 20th, the Court sided with Aviator LLC, not only granting the $330 million damages but also ordering the cancellation of Spribe’s trademarks and prohibiting Adjarabet from continuing to use the ‘Aviator’ name for its game.
